  • Past Patent Litigation:
    • Keystone Global, LLC, Plaintiff, v. Flying Fox, Inc., Robert Tekavec, Defendants. Case No. 1:21-cv-01279. United States District Court, S.D. New York.  Keystone Global, LLC, plaintiff, sued Flying Fox, Inc. and Robert Tekavec as defendants. The lawsuit, filed by the law firm Faegre Drinker Biddle & Reath on behalf of Keystone Global, concerned patent claims related to the defendants’ Bumper Bat rear bumper protective devices.  We at Verna Law, PC, represented the defendants, arguing that the patents of the plaintiff did not have similar mechanisms, especially in light of the defendants having their own patented devices.While the plaintiff filed a motion for summary judgment, the court did not rule in favor of the plaintiff.  This patent infringement lawsuit settled with confidential details.
    • Anthony M. Verna III, Managing Partner of Verna Law, P.C., is a veteran of patent infringement litigation, having worked on the Aricept patent infringement litigation in the United States involved Eisai Co., Ltd. and its U.S. subsidiary, Eisai Inc., filing a lawsuit against Teva Pharmaceuticals and its division Gate Pharmaceuticals. The lawsuit contested Teva’s submission of an abbreviated new drug application for Aricept (donepezil hydrochloride tablets), a treatment for Alzheimer’s disease. In March 2008, the United States District Court for the District of New Jersey granted Eisai a favorable preliminary injunction, preventing the sale of Teva’s generic product before the expiration of the donepezil composition of matter patent.
  • Past Trademark Litigation:
    • PBTM LLC v. Football Northwest LLC et al, Case No. 2:19-cv-02081, W.D.WA; centered on a trademark dispute involving the use of the number “12” and the term “VOLUME 12.” PBTM, previously known as Volume 12, LLC, is a Nevada limited liability company that, since 2009, has developed a business around merchandise branded with the trademark “VOLUME 12,” a brand identity regarding fan support for the Seattle Seahawks NFL team. The lawsuit names Football Northwest LLC (associated with the Seahawks) and NFL Properties LLC as defendants.  This case settled favorably.
    • Sheree Cosmetics LLC v. Kylie Cosmetics, LLC (2:19-cv-06537, C.D. CA); centered around allegations of trademark infringement, false designation of origin, false endorsement, unfair competition, and trade dress infringement. Filed on October 22, 2018, Sheree Cosmetics accused Kylie Cosmetics of infringing on its trademark-protected slogan “Born To Sparkle” by using it on a shade in Kylie’s liquid eyeshadow products. Additionally, Sheree alleged that Kylie Cosmetics copied its “inherently distinctive packaging” by imprinting quotations inside the product packaging, which they claimed could confuse consumers into believing they were purchasing Sheree’s products. The defendants, including Kylie Cosmetics and affiliated entities, sought to dismiss the case on several grounds, including lack of personal jurisdiction and improper venue, and requested a transfer to the Central District of California, arguing that the case had a tenuous connection to the original filing district and that all defendants resided in or had principal places of business in California. The court decided to transfer the case to the Central District of California, considering the convenience of the parties and the interests of justice, without ruling on the merits of the trademark-infringement claim, allowing the plaintiff the opportunity to amend their complaint in response to the defendants’ motion.
    • RCRV, Inc. v. American Blues Company Inc. et al” (Case Number 1:2014cv01646), The plaintiff is RCRV, Inc., and the defendants include American Blues Company Inc., XYZ Companies 1-10, and John and Jane Does 1-10. This legal action involves issues related to trademark infringement under the cause of action 15 U.S.C. § 1051. The nature of the suit is trademark related and was settled successfully.

  • Past Copyright Litigation:
    • Archie Comic Publications, Inc. v. Penders, 1:10-cv-08858 SDNY; Archie Comic Publications filed this case against Ken Penders, whom Anthony Verna, intellectual property lawyer, represented. Mr. Penders was a former independent contractor who contributed to the Sonic comics. Sega had granted Archie Comic Publications the rights to create Sonic comic books starting in 1992. Between 1993 and 2005, Penders created content for these comics, including scripts and artwork. Penders later registered copyrights for his work done for Archie Comics and, in 2010, alleged that Archie Comics was infringing on his copyrights. Archie Comics sought a legal remedy to cancel Penders’ copyright registrations, seeking declaratory judgment and remedies for breach of contract and tortious interference due to Penders threatening legal action. The suit concluded on July 1, 2013, when all claims and counterclaims were dismissed with prejudice, meaning they cannot be filed again on the same grounds. The dismissal followed a confidential settlement agreement reached during a mediation session.
