Your Domain Name is Your Business’ Brand

Maybe you are a domain name owner involved in a domain name dispute with an overzealous trademark holder. Maybe you’re a trademark owner who is the victim of abusive domain name registration. Verna Law, P.C. handles domain name disputes of all kinds, in Federal Courts and WIPO/NAF arbirtration, according to Uniform Domain-Name Dispute-Resolution Policy (UDRP) guidelines. The Uniform Domain-Name Dispute-Resolution Policy (UDRP) is a process established by the Internet Corporation for Assigned Names and Numbers (ICANN) for resolving disputes over domain names. Specifically, it addresses cases where a domain name is identical or confusingly similar to a trademark, has been registered and is being used in bad faith, and the domain name registrant has no legitimate interests in the name.  A UDRP proceeding begins when a trademark owner files a complaint with an ICANN-approved dispute resolution service provider, such as the World Intellectual Property Organization (WIPO). The complaint must detail how the domain name in question violates the UDRP criteria. The domain name registrant is then given the opportunity to respond, defending their right to the domain name.  The proceeding is typically conducted online and involves a panel of one or three experts who review the evidence and make a decision. If the panel rules in favor of the complainant, the domain name can be canceled or transferred to the complainant. UDRP decisions are binding but can be challenged in court. The UDRP offers a streamlined, cost-effective alternative to litigation for resolving domain name disputes, promoting fairness and protecting trademark rights on the internet.

The team at Verna Law, P.C. is committed to helping you in complex legal matters. Whether your domain is currently under threat or you need to proactively file a complaint against abusive registrations of domain names, our attorneys are well-versed in the nuances of domain name disputes and the value of a domain name.
